By using our website and buying wine from us you are agreeing to our Terms & Conditions as set out below.

It is our policy to not sell alcohol to anyone under the age of eighteen in accordance with the law. By placing an order with us you are confirming you are over eighteen. If the wine you purchase is a gift then the recipient must also be over eighteen.

If you purchase wine on our site and you are unhappy with the quality or simply do not like the wine, we will refund you for the wine that has not been opened and remains in saleable condition on its return. (See returns policy).
If your wine does not arrive in reasonable condition you should notify us as soon as possible. If the wine is visibly damaged on delivery you should refuse delivery and request that the wine is returned to us and we will replace it free of charge when we are notified of this by you.

If when you order we find that a wine is out of stock, we will contact you to authorise a suitable substitute or refund the wine to your card. Occasionally due to natural time progression we will be changing to a more recent vintage. Unless the wine is from a region that has specific vintage variation we will automatically substitute the new vintage into your order. Vintages shown on both label and bottle shots of wines may not be representative of current vintage.

The prices for goods displayed for sale on the Site are as displayed on the Site, and are inclusive of VAT and Duty at rates valid as of time of purchase. Additional charges include delivery fees only, and these prices are clearly marked on the ‘Checkout’ page, and advertised on the ‘Delivery’ page. All prices are quoted in Euro. They include VAT and are per bottle or per case as marked. We do not accept responsibility for typographical errors. Prices can change at any time without notice.
By completing and submitting the electronic order form on the site, you are making an offer to purchase goods which, if accepted by us, will result in a binding contract.
By making that offer to purchase goods, you are also authorising Searsons Wine Merchants and any payment processor used by the company to pre validate the Debit or Credit card presented for payment for the full value of the goods and related service charges contained in your basket.
We will confirm acceptance of your order by email. This confirmation will be sent to the email address you provide on your order details. Whether or not you receive an email, our acceptance of your order will create a legally binding contract between us. We reserve the right not to supply you at our discretion.

Searson’s gift cards are available to be spent online at www.searsons.com (Online Voucher) or in our Monkstown shop (Shop Voucher).
To redeem a online gift voucher, shop as usual on our website and proceed to checkout. During checkout you’ll be asked to enter the code for each voucher you wish to redeem. After entering the gift voucher code(s), your order will be automatically updated with credit to the value of the voucher(s). If there’s any balance to pay, you can use a debit or credit card in the usual way.

In respect of the Content that is available on the Site, Searsons will use its reasonable endeavours to resolve faults. You agree that Searsons will not be responsible for any losses (other than damages for death or personal injury resulting from Searsons negligence) you may incur as a result of your use or non-use of that Content.

Searsons is committed to protecting the privacy of those using our Site. The information that you provide about yourself to Searsons or their trading partner Tindal Wine Merchants and will only be used by them in accordance with their Privacy Policy.

In endeavouring to improve the Site and services offered, Searsons reserve the right at all times to make changes to the Content, including these Terms & Conditions. Prices and products are subject to change without notification. You will be subject to the policies and Terms & Conditions in place at the time of your visit to the Site.

Your security and peace of mind are of the greatest importance to us. We endeavour to take all responsible steps to protect your personal information.
Any sensitive data (including personal data and payment information) you send us from your computer is securely encrypted and protected using Internet standard encryption technology known as SSL (Secure Sockets Layer). This process scrambles any sensitive data you transmit to us, preventing it from being intercepted during transmission.

There is no specific time limit applying to your access and use of the site. However, Searsons reserve the right to suspend or terminate your access and use at any time. It may exercise the right with or without notice.
You may not assign, sub-licence or otherwise transfer this Agreement or your rights of access to the Site.
Failure by either party to exercise any right or remedy under this Agreement does not constitute a waiver of that right or remedy
Irish law will apply to this Agreement and both you and Searsons agree to submit to the non-exclusive jurisdiction of the Irish Courts. All contracts that result from the use of this website are concluded in English.
Relevant legislation governing these Terms & Conditions is the Sales of Goods (Supply of Services) Act, 1980, the Consumer Information Act, 1978, the Electronic Commerce Act, 2000, the EU Directive on Distance Selling, SI 207 of 2001 and SI 68 of 2003, the Data Protection (Amendment) Act, 2003 and the Copyright & Related Act, 2000.
